Do you need a permit for a fence in Volusia County, Florida?
Until recently, the answer was always yes. However, as of June 5, 2025, Ordinance 2025-13 removed the building permit requirement for most residential fencing in unincorporated Volusia County. The major exception is if the fence serves as a pool safety barrier. If you don’t have a pool, or if your pool is already secured by a screened enclosure or separate code-compliant barrier, you likely do not need a permit for new perimeter fencing.
Requirements That Still Apply
- Jurisdiction: This exemption only applies to unincorporated Volusia County. If you live within city limits (like DeLand, Deltona, or Orange City), you must still follow city-specific permitting rules.
- Height & Setbacks: Residential fences are generally limited to six feet in rear/side yards and four feet in front yards. Corner lots have stricter "visibility triangle" rules.
- Orientation: Fences must be installed with the finished side facing out toward neighboring properties or the street.
